City of the Future: A Design and Engineering Challenge National Contest
OFFICIAL RULES
THESE OFFICIAL RULES ARE INTENDED AS AN ADDENDUM TO THE COMPETITION BRIEF FOR THE CITY OF THE FUTURE STAGE I COMPETITION. THE TERMS AND CONDITIONS OF THE COMPETITION BRIEF ARE INCORPORATED HEREIN BY REFERENCE. IN THE EVENT OF ANY DISCREPENCY BETWEEN THESE RULES AND THE COMPETITION BRIEF, THE COMPETITION BRIEF WILL GOVERN.
1. ELIGIBILITY: Participation in The History Channel® City of the Future: A Design and Engineering Challenge National Contest is limited to the following three design-firms who were selected as the winners of the Regional City of the Future: A Design and Engineering Challenge held in Washington, DC, San Francisco, CA and Atlanta, GA ("participant" or "participants"):
- Beyer Blinder Belle Architects and Planners DC Winner
- IwamotoScott Architecture SF Winner
- EDAW/Praxis 3/BNIM/Metcalf & Eddy Atlanta Winner
The theme of the contest is for participants to develop visions of their city 100 years from now. These visions are presented through a written statement, a 3-dimensional construct that was assembled within a 3-hour period during Phase I of the competition and accompanying visuals.
2. TO ENTER: To enter this contest, participants must submit the following materials to Administrator to be posted on www.history.com/cityofthefuture within the 24 hour period following their regional event: 1) up to 150 word project summary explaining their City of the Future proposal presented during the regional event 2) three (3) images from their event submission (in JPG format). The materials must be appropriate and suitable for publication and broadcasting, not containing any vulgar, lewd, defamatory, profane or violent material. If Sponsor or Administrator (as such terms are defined below) determines, in its sole discretion, that an entry is not in compliance with these Official Rules, the entry will be automatically disqualified.
3. WINNER SELECTION: Participants submissions will be posted on www.history.com/cityofthefuture from February 4th, 2008 May 5th, 2008 where the Grand Prize Winner will be determined by public voting that is submitted as part of entry for "The History Channel City of the Future Sweepstakes." The public will be encouraged to evaluate submissions based on the following criteria:
- Lessons learned from the Cities of the Underworld series;
- Responsiveness to the design challenges cited in the competition brief;
- Originality of the team's design proposal and three-dimensional construct;
- Thoughtfulness of the vision's response to the existing city and its context;
- Clarity of presentation and presentation materials;
- Quality of the proposed vision;
- Complexity of the team's construct
The participant that receives the most public votes will be named the Grand Prize Winner. Should two or all three of the submissions receive the same total number of votes, the winner will be determined by using the following tie-breaker mechanism. A celebrity judge will determine the winning submission from among the tied submissions by evaluating the submissions based on the same judging criteria as was used by the Jury in the regional event competition (as set forth in the Competition Brief).
4. PRIZES: Grand Prize (1): Five Thousand Dollars ($5,000). Prizes are nontransferable. Prizes will be awarded to the principal firm leading each design team. All expenses not specified in these Official Rules, including without limitation, meals, taxes, incidentals and other expenses, are the winner's sole responsibility. Taxes are the sole responsibility of prize winner.
5. GENERAL RULES: Contest is governed by the laws of the State of New York, with venue and jurisdiction in New York County, NY and all claims must be resolved in the courts located in New York County, NY. All federal, state and local laws and regulations apply. Sponsor and its agencies are not responsible for incomplete, lost, late, damaged, illegible or misdirected e-mail, for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor and its agencies are not responsible for any damage to any participant's computer system/software related to or resulting from participation or downloading any materials in this promotion. Participant further acknowledges and agrees that (a) while Sponsor will seek to accurately post images on the web site, the images as posted on the web site may differ from the images as originally submitted by participant due to technological malfunction/error/defect/limitation/modifications and Sponsor and Administrator shall have no liability related thereto; and (b) Sponsor may post images in any order, sequence, format or pattern, with or without additional commentary, at its sole discretion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. If for any reason the promotion is canceled, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes outside control of Sponsor which impair or affect the administration, security, fairness, integrity, or proper conduct of this promotion, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the contest. In the event of termination, participants will be notified and the winner will be selected by celebrity juror or by such other means as sponsor determines in its sole discretion is fair, appropriate and is consistent with the spirit of the Official Rules. Potential Grand Prize winner must sign and return an Affidavit of Eligibility/Release of Liability/Release of Publicity (where legal) within 10 day of date of notification email in order to claim prize; failure to do so may result in disqualification. Disqualification/Award of Prizes: In the event of disqualification of Grand Prize winner, the participant to receive the second greatest amount of public votes will become the Grand Prize winner. Grand Prize Winner will be issued an IRS 1099 Income Tax Form in the amount of the Actual Retail Value of the prize as it exceeds $600. Return of any prize/prize notification as undeliverable will result in disqualification. The prize will be awarded. By participating in this promotion, entrants agree to be bound by the Official Rules which are final and binding in all matters related to the contest. By accepting prize, winners agree to hold A&E Television Networks, Civic Entertainment Group, LLC, their affiliates, subsidiaries, prize suppliers, advertising and promotion agencies, their respective officers, employees, directors, and representatives harmless against any and all claims and liability arising out of use of prize. Winners assume all liability for any injury or damage caused, or claimed to be caused by participation in this promotion or use or redemption of any prize. Sponsor not responsible for typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.
5. WINNERS' LIST: For names of winner, send a stamped, self-addressed envelope to be received no later than May 16. 2008, to: "City of the Future" National Contest, Winner's List c/o CEG, 450 Park Avenue, New York, NY 10016.
6. SPONSOR & ADMINISTRATOR: The "Sponsor" of this Contest is A&E Television Networks, 235 East 45th Street, New York, NY 10017. The "Administrator" of this Contest is Civic Entertainment Group LLC 450 Park Avenue, New York, NY 10016.
